RE: The tariff classification of a girl’s playsuit from China

Dear Mr. Armani:

In your letter dated February 15, 2001 you requested a tariff classification ruling.

Style 3X26043 consists of a short leg bib and brace overall and a cap sleeve shirt. The bib and brace overall is made from a woven denim fabric that you indicate is 100% cotton and the top is made from a fine knit fabric that you indicate is 100% cotton.as well.

The bib and brace overall has a slightly tapered front bib with a straight top edge. The garment lacks a back bib, but adjustable self-fabric straps are sewn to the center of an upward extension of the back. These straps are brought forward over the shoulders, and are fastened by means of a metal loop to buttons sewn on the top corners of the front bib. There is a one-button closure at the waist on each side. A fabric panel, which reaches to near the bottom of the legs, is sewn across most of the waistband and down most of the length of the right side seam. The loose sides of this panel are finished with rickrack. There is a patch pocket on the right rear hip and embroidery on the bib front and on the panel.

The shirt has a partial back opening, cap sleeves finished with elastic, a hemmed bottom, a round neckline trimmed both with contrasting color capping and a row of rickrack. The knit fabric is printed with designs that match the embroidery of the overall. There is a narrow self-fabric loop located on the top of each shoulder. The bib and brace overall straps are threaded through these loops. You have stated that Style 3X26043 will be imported in sizes 2T-4T and 4-6X.

The applicable subheading for the overalls will be 6204.62.2025, Harmonized Tariff Schedule of the United States (HTS), which provides for Women’s or girls’ suits, ensembles, suit-type jackets, blazers, dresses, skirts, divided skirts, trousers, bib and brace overalls, breeches and shorts (other than swimwear): Trousers, bib and brace overall, breeches and shorts: Of cotton: Other: Bib and brace overalls: Other: Girls: Imported as parts of playsuits. The rate of duty will be 9.1 percent ad valorem.

The applicable subheading for the shirt will be 6106.10.0020, HTS, which provides for Women’s or girls’ blouses and shirts, knitted or crocheted: Of cotton: Girls’: Imported as parts of playsuits. The rate of duty will be 20.1 percent ad valorem.

Both pieces of Style #3X26043 fall within textile category designation 237. Based upon international textile trade agreements, products of China are subject to quota and the requirement of a visa.

The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the U.S. Customs Service Textile Status Report, an internal issuance of the U.S. Customs Service, which is available at the Customs Web Site at WWW.CUSTOMS.GOV. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should be verified at the time of shipment.

In accordance with your request, your samples will be returned to you separately.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).

A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
